How is the governing board structured? 
Owners within the Community automatically become members of the Community Company.  The CC&R’s, Articles of Incorporation and By Laws for the Community Company, and any rules and regulations that may be adopted, define the individual rights, duties and responsibilities of the Community Company and the owners. 

The Board of Directors is the governing body that conducts the business of the Community Company. Initially, the Declarant appoints the members of the Board and will initially consist of five members.  Over time, the Declarant appointed Board gradually transitions to Board Members elected by Delegates. For every 10,000 homes a new board member will be added. 

What interests and voting rights do I have as a member?

Each person who is an owner of the fee interest in any unit type is a member for the Community Company.  Due to the mixed-use nature of Mesa del Sol, there are a number of different types of units that receive various kinds of service from the Association.  Each residential home will have one vote and the other voting allocations can be reviewed in the CC&R’s, Article IV, Section 4.2.

What documents are associated with the management company?
The community association is a combination of homes and retail spaces in a planned community subject to governing documents.  Prospective buyers should obtain and review copies of the following documents: 

  • Articles of Incorporation
  • Declaration of the Covenants, Conditions and Restrictions (CC&R’s)
  • By Laws
  • Rules and Regulations

Who is HOAMCO?
The Board of Directors may contract with a professional management company to take care of the day-to-day business.In this manner, the Board becomes an executive decision making body, while Association’s day-to-day business is handled by professionals.At Mesa del Sol, the Board of Directors has hired HOAMCO, as the management company.HOAMCO has been in business for over 21 years and is one of the leading management companies in New Mexico.HOAMCO has assigned a manager to the Mesa del Sol who can be reached at (505) 224-2074 or by mail at MdS Community Company c/o HOAMCO, PO Box 67590, Albuquerque, NM 87193-7590. What items do I need to send to HOAMCO and Design Committee?
Design Review is limited to residential units and is only for material changes to the exterior of a home.  Approval is required for:

  • Increase the interior gross square footage of such Residential Improvements,
  • Add or modify an exterior deck or balcony at the primary entry to such Residential Improvements or above the ground floor thereof,
  • Substantially modify the architectural style or character of the Residential Improvements in the opinion of the DRC (Design Review Committee),
  • Add or modify any accessory or additional structure thereto; provided however, sheds and storage structures do not require DRC approval, or
  • Substantially modify the roof plan or line of any Residential Improvements. 

What items do NOT have to be approved by HOAMCO and the Design Committee?

  • Modifications to exterior colors,
  • Additions of or modifications to fencing or walls,
  • Landscaping,
  • Additions of or modifications to any shed or storage structure,
  • Modifications to any primary entrance door,
  • Additions of or modifications to any deck or balcony that is at ground level and not at the primary entrance to a Residential Improvement,
  • Rebuilding, repairing or restoring any damaged improvement consistent with the installation or construction thereof by the initial Builder or consistent with the most recent plans and specifications therefor approved by the DRC or Founder,
  • Activities of Founder, Mesa del Sol, LLC (including additions of or modifications to any improvements conducted or approved by Founder), and
  • Any other improvements and activities as determined by the DRC from time to time.
